1. About these terms

Sky Score is a trading name of CUBITT33 LTD, a company registered in England and Wales (company number 13651304), whose registered office is 50 Pembroke Road, London W8 6NX. Web: skyscore.co.uk. Contact: support@skyscore.co.uk.

References to "we", "us" and "our" in these terms are to the operator named above.

These terms govern your use of the Sky Score website, the iOS and Android apps, and the Sky Score API. By using any of them you accept these terms. If you do not accept them, please do not use Sky Score.

If you have signed a separate written agreement with us, for example a pilot agreement or an API licence, that agreement governs the services it covers and prevails over these terms wherever the two conflict.

2. What Sky Score is, and what it is not

Sky Score computes a score from 0 to 10 for a location, from published datasets, using a documented and versioned methodology. It is an information tool. It is designed to make hidden characteristics of a place easier to see.

Sky Score is not:

• a survey, valuation, or structural report
• financial, mortgage, investment or lending advice
• legal advice, or a substitute for conveyancing searches
• an environmental, flood or contaminated land report
• a statement about any individual property, its condition, or its value

Sky Score is not regulated under the Estate Agents Act 1979 or the Property Misdescriptions Act 1991, and we are not authorised or regulated by the Financial Conduct Authority.

Please do not use a Sky Score as the sole basis for a decision to buy, sell, rent, lend against, insure or invest in a property. It is one input among many, and it is not a replacement for professional advice or your own inspection of a place.

3. Accuracy and the limits of the data

Sky Score is derived from third-party public datasets, each listed with its source and licence in LICENSING.md. We do not control those datasets and we cannot guarantee them.

Published data lags reality, sometimes by years. Official datasets are released on their own schedules and we publish the vintage of each one in our methodology. Where a dataset is known to be anomalous or unusually old, we say so there. A score describes the data we hold, not the state of a place today.

Scores change. They change when a source dataset is refreshed and when our methodology is revised. The methodology is versioned like software and every change is recorded in our changelog. A score you saw previously may not be the score you see now, and neither is a promise about the future.

To the fullest extent permitted by law, we give no warranty that Sky Score, its scores, or any data it returns are accurate, current, complete, or fit for any particular purpose.

4. Acceptable use

You may use the free consumer website and apps for your own personal, non-commercial purposes. You may not:

• scrape, harvest or bulk-extract scores or data in order to reconstruct our dataset or build a competing product
• use automated means to place unreasonable load on the service, or attempt to circumvent rate limits or quotas
• resell, redistribute or present Sky Score data as your own without a written licence from us
• remove or obscure any attribution required by the third-party licences described in section 6
• use Sky Score for any unlawful purpose, or in any way that could damage or impair the service

Commercial and high-volume use is what the API is for. If you want to use Sky Score in a product or a workflow, talk to us about a licence rather than working around these limits.

5. The API and paid services

API access is granted by key. Keys are issued to you and you are responsible for keeping yours confidential and for all use made of it. Tell us promptly if you believe a key has been exposed and we will revoke and reissue it.

Each tier carries a published request quota and rate limit. We may change quotas, rate limits and tier pricing, and we will give reasonable notice of changes that reduce what a paying customer already receives.

We may suspend or revoke a key without notice where we reasonably believe it is being used in breach of these terms, or where continued use threatens the stability or security of the service.

6. Third-party data and attribution

Sky Score is built on public data, most of it under the Open Government Licence v3.0. Two sources carry different terms that pass through to you if you integrate our data:

• OpenStreetMap data is licensed under the Open Database Licence 1.0, which is share-alike rather than permissive and carries a mandatory attribution requirement
• Transport for London Open Data carries its own licence and its own attribution requirement

Every API response includes a sources array naming the datasets used to produce it. If you display or redistribute Sky Score data, you must carry that attribution through to your own users. Full per-source detail is in LICENSING.md.

The Sky Score name, branding, and the methodology and software that produce the scores remain ours. Nothing in these terms transfers ownership of them to you.

7. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, your statutory rights are unaffected by anything in this section.

Free services. The website, the apps and the free API tier are provided without charge and, to the fullest extent permitted by law, are provided as they are, without warranty of any kind. We are not liable for loss or damage arising from reliance on a score obtained through them.

Paid services. Where you have paid us, our total liability to you in connection with the services, whether in contract, tort including negligence, breach of statutory duty or otherwise, is limited in aggregate to the total fees you paid us in the twelve months immediately preceding the event giving rise to the claim.

Business users. If you are using Sky Score for the purposes of a business, we are not liable to you for loss of profit, loss of revenue, loss of anticipated savings, loss of business or opportunity, loss of goodwill, or for any indirect or consequential loss, however arising.

These limits reflect that Sky Score is an information service built on public data, that the free service is provided at no charge, and that decisions about property are made by you with the benefit of professional advice.

8. Availability

We aim to keep Sky Score available but we do not guarantee uninterrupted access. The free website, apps and free API tier carry no service level commitment, and we may change, suspend or withdraw any part of them. Service levels for paid tiers, where offered, are set out in the relevant written agreement.

9. Your data

How we handle personal data is set out in our Privacy Policy, which forms part of these terms. Browsing and scoring require no account and collect no personal data. The one exception is the email address you give us if you request an API key.

10. Changes to these terms

We may update these terms. The "Last updated" date at the top records when we last did. Material changes will be notified in the same way as changes to the Privacy Policy. Continuing to use Sky Score after a change means you accept the updated terms.

11. Governing law

These terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.
